How do SOPA deadlines work?
Under SOPA, the respondent (the party who received the payment claim) must serve a payment response within 14 days of receiving a payment claim under a construction contract, or within the period specified in the contract if shorter.
If the respondent fails to serve a payment response, or serves one for less than the claimed amount, the claimant may lodge an adjudication application. The window to do so opens on the day after the payment response period ends, and closes 7 days later.
Missing the adjudication application window is final. Once it closes, the claimant cannot adjudicate that particular payment claim. A new payment claim may be possible but is subject to separate conditions.
What happens after adjudication?
Once an adjudication application is lodged, an adjudicator is appointed within 7 days. The respondent then has 7 days to lodge an adjudication response.
The adjudicator typically issues a determination within 7 days of the adjudication response, or within 14 days if the adjudicator requests an extension.
If the determination is in the claimant’s favour and the respondent fails to pay, the claimant can apply to the High Court to enforce the determination as a court judgment.
